FDA Warns of Injury from Recalled Mighty Bliss Heating Pads

When a defective product makes its way into the hands of unsuspecting consumers, the consequences can be life-altering. Consumers can suffer injuries ranging in severity from mild skin irritation to death.

In the United States, the Food and Drug Administration (FDA) is charged with protecting public health through a variety of measures, including ensuring the “safety, efficacy, and security” of medical devices. Additionally, the Consumer Product Safety Commission (CPSC) is responsible for protecting public safety by “reducing the unreasonable risk of injuries and deaths” from consumer products.” Consumer injuries are often the result of one of the following product defects:

  • Design
  • Manufacturing
  • Labeling

On October 24, 2022, the FDA issued a warning after Whele LLC (doing business as Perch) recalled 544,212 specific Mighty Bliss electric heating pads due to consumer reports of injury, including electric shock, skin burns, blisters, rashes, and irritation. The affected model numbers and product lots can be found in the FDA’s warning, and the original Whele LLC recall notice.

The law firm of Carpenter & Zuckerman is conducting an investigation into these claims. Consumers who have been negatively affected by the recalled Mighty Bliss electric heating pads may be eligible for compensation. Details of the Mighty Bliss Electric Heating Pad Recall

On October 18, 2022, Whele LLC issued a voluntary recall of 544,212 Mighty Bliss electric heating pads. The specific heating pads affected were manufactured between January 8, 2021 and January 2, 2022 and were distributed through Amazon.com and Walmart.com from July 29, 2021 through July 21, 2022.

The recall was issued after Whele, LLC received 286 consumer complaints of electrical problems with the product, including overheating, sparking, and burning. Just over ten percent of the complaints involved consumer injuries, including electrical shock, burns, rashes, and irritation.

Consumers were instructed to:

  • Cease using the recalled product

Who Is Liable for Consumer Injuries from Defective Products?

When an innocent consumer is injured by a defective product, who is ultimately liable? In our world of global e-commerce, numerous entities are involved in the process between conceptualizing a product and delivering the finished product into the hands of consumers.

When it comes to product liability lawsuits in California, any entity along the stream of commerce who participates in delivering a defective product into the hands of consumers is potentially liable, whether or not they ever have physical possession of the detective product. This includes, but is not limited to, product designers, manufacturers, suppliers, online retailers, and individual sellers.

Why is this strict liability approach important for consumers? When each participating entity is potentially liable for a product’s safety and performance, it removes the burden of proof from the injured consumer. In California, an injury victim does not have to prove negligence in order to assert their product liability claim. Instead, an injured party must only prove:

  1. The product was unreasonably dangerous

  2. The plaintiff sustained injury

  3. The injury was caused by the defective product

If you believe you have been injured as the result of a defective product, follow these steps:

  • Photograph your injuries, as well as the defective product

  • Preserve the product packaging and instruction manual, if possible

  • Seek a medical evaluation to document your injuries

  • Report your injuries to the FDA or the CPSC

  • Contact an experienced product liability lawyer as soon as possible
