Joseph Schwar is a skilled litigator with over two decades of experience. Joseph’s practice has included pursuing damages for individuals who have sustained injury due to another’s negligence and securing the compensation they need to get back on their feet.
Prior to joining Carpenter & Zuckerman in 2022, Joseph worked for over sixteen years with boutique law firm Peterson Law Group, where he managed eminent domain and inverse condemnation litigation, and appellate work on behalf of owners of real property and businesses taken and damaged by public projects.
During that time, Joseph obtained a published opinion from the California Supreme Court (Weiss v. People ex rel. Dep’t of Transp. (2020) 9 Cal. 5th 840) to overturn prior law that had allowed public agencies to bring a Dina Legal Issues Motion to summarily defeat inverse condemnation claims without satisfying procedural protections that must be met in order to support a true Motion for Summary Adjudication.
As an attorney, Joseph has also successfully represented numerous clients whose properties were damaged by landslides, land subsidence, or debris flow. Joseph is well-versed in matters pertinent not only to litigation of personal injury claims but also to bad faith claims against insurers, environmental contamination and remediation, commercial transactions, and even oil and gas leases.
