Carpenter & Zuckerman Announces $2.5 Million Verdict For Client In Trip & Fall Case

LOS ANGELES, May 29, 2018 — Trial attorneys Robert Ounjian and Pej Ben-Cohen of the law firm Carpenter & Zuckerman announced a verdict of $2.5 million for a client who tripped and fell over a stub covered with duct tape in a CVS parking lot.

On December 24, 2012, the plaintiff was walking from her house to the CVS Pharmacy at Sherman Oaks Shopping Center to purchase some items.  While she was walking through the parking lot between parking stops, she tripped and fell over a stub covered with duct tape.  It was later discovered the stub was the bottom portion of a handicap sign that was knocked over before the fall.  The property owner had knowledge of the sign being knocked over and the remaining stub.

The next morning, she went to the hospital with pain all over her body and left wrist.  An MRI would later reveal injuries to the spine including the C5, C6, L4, and L5 discs.  After undergoing 4 cervical rhizotomies, an endoscopic lumbar discectomy, and a two level fusion, she incurred over $400,000 in medical expenses as a result of the fall and years of pain and suffering.

“Our client was simply walking through a parking lot, something most of us do every single day, and fell over a negligently duct taped stub from a parking sign which had fallen over,” said Robert Ounjian.  “Had a cone, caution tape, or some other type of safety device been put over that stub, our client would never have endured the injuries, pain, and suffering she went through and will continue to go through.”

“While the defense in this case admitted liability right before the trial, they instructed the jury to pay our client $10,000 in medical expenses and $5,000 for pain and suffering,” added Pej Ben-Cohen.  “Our client went through significant medical procedures resulting in real medical expenses, not to mention years of undue pain and suffering, and the jury was able to see that and act accordingly.”

The jury in the case awarded $403,951.76 in past medical expenses, $297,774 in future medical expenses, $550,000 in past pain & suffering, and $1,300,000 in future pain and suffering resulting in a total verdict of $2,551,725.76
